Upon
conviction, you have a limited amount of time to file an appeal. This
time varies from as little as ten (10) days in a federal
case to
forty-two (42) days in state court and fourteen (14) days in state
district courts. It is extremely important that we file a timely notice
of appeal in your case. Otherwise, the appellate court is without power
to hear your case and the conviction stands. Our firm thoroughly
reviews the handling of your appeal. By examining the trial transcript
and all other documents/evidence, we can determine if there is a good
basis for the appeal. If you were convicted of a felony, your
appeal (after sentencing) would be filed in the Alabama Court of
Criminal Appeals in Montgomery. That court hears all appeals of
felonies. If the Alabama Court of Criminal Appeals decides your case
and upholds the conviction it can be taken further to the Supreme
Court of Alabama. If you were convicted of a misdemeanor in
District or Municipal Court, the appeal has to be filed within 14 days
to the Circuit Court for a brand new trial. The previous conviction is
tossed out. However, it has to be filed timely. In addition to
filing appeals, there are many post-conviction motions/petitions that
can be filed to overturn or limit the conviction/sentence. Please contact Attorney Steven F. Long by clicking APPEALS to discuss any further and specific questions you may have.
